TERMS & CONDITIONS

These Terms & Conditions govern the provision of services by Peak State Limited (“Peak State”, “we”, “us”, “our”) and apply to all clients (“you”, “your”) who engage with our services.

By purchasing, accessing, or participating in any Peak State service, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

1. About Peak State Limited

Peak State Limited is a New Zealand-registered company providing training coaching, nutrition coaching, and performance support services. Our services are non-clinical, education-based, and coaching-focused, designed to support general health, wellbeing, and performance.

2. Scope of Services

Peak State may provide services including, but not limited to:

  • Generic training programmes

  • Nutrition coaching and meal planning

  • Online coaching and app-based support

  • Team training and recovery sessions

All services are provided within a coaching scope only and are not medical or therapeutic in nature.

3. No Medical or Clinical Services

You acknowledge and agree that:

  • Peak State does not provide medical advice, diagnosis, treatment, or medical nutrition therapy

  • Our services do not replace advice from a qualified healthcare professional

  • You should consult a doctor or a qualified health professional before starting any new

  • training or nutrition programme, particularly if you have/are:

    • A medical condition

    • An injury

    • A history of eating disorders

    • Pregnant or breastfeeding

    • Taking prescribed medication

4. Client Responsibility

You acknowledge that:

  • You are responsible for your own health, safety, and wellbeing

  • You must disclose all relevant medical conditions, injuries, medications, allergies, intolerances, or limitations

  • You will stop or modify activity if you experience pain, dizziness, or discomfort

  • You participate in all services at your own risk

Peak State is not responsible for outcomes resulting from incomplete or inaccurate information provided by you.

5. Results Disclaimer

You acknowledge that:

  • Results vary between individuals

  • No specific outcomes or timeframes are guaranteed

  • Progress depends on factors including consistency, adherence, lifestyle, genetics, and external circumstances

Peak State makes no guarantees regarding physical, aesthetic, or performance outcomes.

6. Packages, Subscriptions & Minimum Commitments

Personalised nutrition plans are delivered via subscription-based packages with a minimum 12-week commitment, unless stated otherwise at the time of purchase.

By purchasing a subscription, you agree that:

  • The minimum commitment period applies regardless of usage

  • Payments will continue during the commitment period

  • Access to services may be paused or restricted if payments fail

Ongoing services continue on a rolling basis following the minimum commitment unless cancelled in accordance with these Terms.

7. Payments & Billing

  • Payments are processed via secure third-party providers (Stripe) or agreed online banking

  • Subscriptions are billed automatically at the agreed frequency

  • You are responsible for ensuring valid payment details are maintained

  • Failed payments may result in a temporary suspension of services until resolved

8. Cancellations, Refunds & Pauses

Subscriptions

  • Minimum commitment periods are non-refundable

  • Cancellation requests apply after the minimum commitment has been completed

Refunds

  • Refunds are not provided for:

    • Change of mind

    • Missed sessions

    • Non-use of services

  • Any refund decisions are at Peak State’s discretion, except where required by law

Pauses

  • Temporary pauses may be granted at Peak State’s discretion due to injury, illness, or exceptional circumstances

9. Team Training & In-Person Services

For in-person services, you acknowledge that:

  • Physical activity carries inherent risk

  • You are responsible for participating within your limits

  • Peak State may modify or cease activities if safety concerns arise

Peak State reserves the right to refuse or stop services where safety is compromised.

10. Intellectual Property

All materials provided by Peak State (programmes, plans, content, resources) remain the intellectual property of Peak State Limited.

You may not:

  • Share, distribute, or resell content

  • Reproduce materials without written permission

11. Privacy & Confidentiality

We collect and store personal information in accordance with New Zealand privacy laws.

  • Your information is kept confidential

  • Information is only shared with trusted third-party service providers where necessary to deliver services or where required by law

  • You may request access to or correction of your information

12. Limitation of Liability

To the fullest extent permitted by law:

  • Peak State is not liable for any injury, loss, or damage arising from participation in services

  • You release Peak State from claims arising from your participation, except where caused by proven negligence

13. Changes to Terms

Peak State reserves the right to update these Terms & Conditions at any time.

  • Updated terms will be published on our website or app

  • Continued use of services constitutes acceptance of updated terms

14. Governing Law

These Terms & Conditions are governed by the laws of New Zealand. Any disputes will be resolved under New Zealand jurisdiction.
